Bankruptcy fees and costs

Each person we meet with has questions about the cost of bankruptcy. This is a natural concern, which is why I try to be upfront about what we charge. Andress Law Firm handles bankruptcy services on a flat-fee basis. This means there is one charge for your case, depending on what type of case it is, and the nature of the debts and assets that are involved. There are no hidden charges or hourly billing on consumer bankruptcy cases. What you see below is what you get as far as fees are concerned.

Chapter 7 fees & costs

One of the biggest hurdles to individuals seeking bankruptcy relief is the cost.  That is why Andress Law Firm handles personal Chapter 7 cases for only $865.00 plus the filing fee of $335.00 for a total cost of $1,200.00.  This low fee is available to individuals and married couples who need the relief available under Chapter 7 of the Bankruptcy Code.

For business Chapter 7 cases the fees range from $1,500.00 - $7,500.00 depending on the complexity of the case and the issues involved.  Business clients will be quoted a flat fee before the outset of our representation so that they can make an informed decision about the costs.

All fees and costs are payable to Andress Law Firm in the form of either cash, money order or cashier's check. We pay the filing fees on your behalf. These fees and costs are for representation in the Chapter 7 case through discharge, but do not include representation in any adversary proceedings or contested matters that may arise.

Chapter 13 fees & costs

Fees and costs in Chapter 13 cases are set by the judges and depend on the district in which your case is filed. The district where your case is filed depends on where you live. Regardless of the district in which your case is filed, the vast majority of your attorney fees are paid through your Chapter 13 payment plan. The rest of your fees are paid through the Chapter 13 plan according to the chart below.

All fees and costs are payable to Andress Law Firm in the form of either cash, money order or cashier’s check. We pay the filing fees on your behalf. These fees and costs are for representation in the Chapter 13 case through the first year of your case in the Middle District or through 120 days after confirmation of your plan in the Eastern District. We can apply for additional fees if additional work is performed after these periods of time. Additional fees must be applied for and approved by the judges. These fees also do not include any adversary proceedings or contested matters that may arise.

Fees for adversary proceedings and contested matters

Adversary proceedings and contested matters are separate lawsuits that may be filed by you or against you within the context of your bankruptcy case. These types of cases are relatively uncommon. Fees charged for these matters are determined on a case-by-case basis, and we will discuss this directly with you should the need arise.
